Velcrypt Terms of Use

These Terms of Use (“Terms”) govern your use of the Velcrypt iPhone app (the “App”) and the velcrypt.app website (the “Website”), provided by Velcrypt (“we”, “us”). By downloading or using the App or using the Website, you agree to these Terms.

1. The App and Apple’s EULA

The App is distributed through Apple’s App Store. Your use of the App is governed by Apple’s standard Licensed Application End User License Agreement (the “Apple EULA”), together with these Terms. If these Terms and the Apple EULA conflict, the Apple EULA prevails to the extent required by Apple.

These Terms are between you and us, not Apple. Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support for it.

2. Licence

Subject to these Terms and the Apple EULA, we grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple devices that you own or control. You may not copy, modify, reverse engineer (except where the law allows it), resell or redistribute the App, or remove any proprietary notices.

All rights not expressly granted to you remain with us. The Velcrypt name, logo and Website content are our property; you may use press materials from our press kit to write about Velcrypt.

3. Acceptable use

You agree to use the App and Website only for lawful purposes. You must not use them to store, create or distribute content that is illegal where you live, that infringes the rights of others, or that exploits or harms anyone, including minors. You must not attempt to interfere with the Website, its hosting or other users.

Because your vault content stays on your device and is encrypted, we cannot see it. You alone are responsible for what you store.

4. Your patterns, your data

Velcrypt is designed so that no one but you can open your vaults. That has consequences you accept by using it:

We cannot recover your data. Your patterns and keys are never sent to us. If you forget a pattern, the vault it opens cannot be recovered by you or by us.
Lost devices mean lost vaults. In the current version, vault data is excluded from iCloud and computer backups. If your device is lost, stolen, damaged or reset, its vaults are gone.
Keep your own copies. You are responsible for keeping copies of any file you cannot afford to lose, stored somewhere you trust.
Keep your pattern private. Anyone who knows or observes your pattern can open that vault.

5. Purchases

Any purchase, including the optional Premium upgrade, is made through the App Store and is subject to Apple’s terms. Apple processes payment, and refund requests are handled by Apple according to its policies. Prices are shown in the App Store before you buy. Features described as planned or coming soon are not guaranteed until they are released.

6. Changes to the App

We may update, change or discontinue features of the App or Website. We will try to give notice of significant changes. Where possible, we will design changes so they do not make existing vaults inaccessible.

7. No warranty

The App and Website are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We do not warrant that the App will be error-free or uninterrupted, or that it will protect against every threat. No security software can do that.

Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

8. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, content, profits or goodwill, arising from your use of or inability to use the App or Website — including data lost because of a forgotten pattern, a lost or reset device, or deleted files. Our total liability for any claim is limited to the amount you paid for the App in the twelve months before the claim.

Nothing in these Terms limits liability that cannot be limited by law.

9. Termination

You may stop using the App at any time by deleting it; deleting the App deletes its vaults. We may end your licence if you materially breach these Terms.

10. Changes to these Terms

We may update these Terms. We will post the updated version here and change the effective date. Continued use after an update means you accept the revised Terms.

11. Governing law

These Terms are governed by the laws of [jurisdiction TBD], without regard to conflict-of-law rules. Mandatory consumer protection laws of your country of residence continue to apply.
